£17,500 compensation awarded following total hysterectomy

Our medical negligence solicitors successfully secured £17,500 compensation for a Claimant who suffered complications of excessive bleeding during a bilateral tubal ligation (female sterilisation) procedure resulting in a total hysterectomy being performed. 

Birth injury compensation claim

The Claimant was pregnant with her eighth child. At 37+3 gestation, she attended an antenatal appointment and consented to a caesarean section and bilateral tubal ligation procedure. 

The Claimant attended for the planned caesarean section and tubal ligation procedure. Shortly after the birth, the tubal ligation procedure was commenced. However, complications arose when the Claimant started to bleed very heavily which could not be controlled. 

During the procedure, the left cornu was damaged with a suture needle causing vascular bleeding. The Claimant subsequently underwent a total hysterectomy under general anaesthetic and required a blood transfusion. 

Our investigation

Supportive expert evidence was obtained from a Consultant Obstetrician. 

As a result of the negligence, the Claimant required a total hysterectomy resulting in acceleration of the menopause by approximately 2 years and an extended recovery period of approximately 4-6 weeks. 

A Letter of Claim was sent to the defendant Trust who in response denied liability in full.  

Following clarification of our expert evidence, a Letter of Challenge was sent to the Defendant in in an attempt to narrow the issues. 

The defendant subsequently made a formal offer to settle and following a series of negotiations between the parties, the matter settled for £17,500.
