Morrish Solicitors Secure £9,000 Compensation for Injured TSSA Member
A TSSA member in Oxfordshire received £9000 compensation from the Motor Insurers Bureau for damages he suffered in September 2004 in a road traffic accident where the other driver was untraceable.
He was riding his Harley Davidson with a pillion passenger, and lost control of the motorcycle as he tried to avoid a car whose brake lights failed as it came to a stop just over the crest of a hill outside Basingstoke. The case is unusual because the rule of thumb in rear-end collisions is that the person behind is generally at fault.
The member tried to lodge a claim through his insurer, who insisted there was no claim. The member approached Motor Insurers Bureau (MIB) in April 2005 but his application was rejected. Seeing the legal service ad in TSSA Journal the member contacted TSSA.
He said: “I was very dissatisfied with the MIB\’s approach. All I wanted was to prove I was not entirely at fault. When TSSA said they would fund my claim, win or lose, it was a no-brainer for me. John Caselli at Morrish Solicitors looked at my paperwork, got the ball rolling, and formally appealed the MIB\’s decision. The independent arbitrator who reviewed my case gave liability two-thirds in my favour.”
The member had some advice for non-union members: “Join! In this day and age, trying to fight for yourself is almost pointless. Your voice is not heard. Even though I’d paid legal expenses insurance for years, my own insurer would not pursue my claim. The union is a collective voice for ordinary people. They’ve got clout, knowledge and resources and they give us the chance to vote on their actions. You may not necessarily agree with everything the union does, but at least they respect different views.”
