Examples of Never Event Claims

Avoidable mistakes are thankfully rare but when they are made, they can often have devastating consequences. Never events typically include:

  • Wrong site surgery;
  • Wrong implant / prosthesis;
  • Retained surgical instruments;
  • Medication errors;
  • Incorrect transplants;
  • Operating on the wrong patient.

As part of their duty of candour the NHS release data of these never events. The most recent data shows that between 01 April and 30 September 2021 there was a total of 195 incidents. Wrong site surgery accounts for 78 of these incidents and retained surgical instruments accounts for 45.

The impact of a never event is varied and, in some cases, can mean further medical intervention is required leading to long term health consequences.

Our team of medical negligence specialists can provide invaluable support and can recover compensation to allow you to access further treatment and rehabilitation. Our team will provide support and guidance to help you through the claim process.

Making a Never Event Compensation Claim

After a never event the NHS will usually begin an Serious Incident investigation. This will explore the circumstances of your injury and outline lessons to avoid a similar mistake in the future. This may provide answers for you or your loved one and can allow you reassurance that lessons have been learned. A claim for medical negligence can provide compensation for the impact of the injury sustained as well as enabling you to recover any financial losses that may have arisen.

We may be able to assist you with your never event claim on a no win, no fee basis giving you the reassurance that you will not have to pay anything if the claim is unsuccessful. Our team of medical negligence specialists will be happy to discuss your funding options in detail.

Never event claims must be brought within 3 years of the date of the alleged negligence or from the date on which you first knew or suspected that you were injured as a result of the alleged negligence.

There are limited exceptions to this rule for claims involving children and protected parties as well as claims brought on behalf of an estate.

Our team of clinical negligence specialists are able to advise you further on the applicable limitation date when discussing your claim.
