Aqua Interiors staff awarded protective award claim
Following the unexpected dismissal of more than one hundred employees and subsequent insolvency of Huddersfield-based kitchen and bathroom installer Aqua Interiors in summer 2016, many of the employees instructed Morrish Solicitors to bring a protective award claim against the company for a failure to inform and consult them appropriately before they were dismissed.
The family-run company, formed 40 years ago, operated across the north of England as an independent installer of kitchens, bathrooms and central heating systems – mainly to local authorities, housing associations and local house builders.
The company had suffered cash flow difficulties in the months prior to its collapse and had been unable to reach agreement with HMRC regarding historic tax arrears which ultimately led to the company entering administration.
Dismissed employees were awarded 90 days’ pay by the Leeds Employment Tribunal for the company’s failure to inform and consult.
Daniel Kindell, who represents the former employees states “we are very pleased that the Tribunal have agreed that the company failed to carry out its legal obligations to these employees and awarded the full award against Aqua Interiors (in administration)”.
