In order to make a protective award claim, you must have been involved in either of the following scenarios:
- Redundancy – If you are 1 of at least 20 employees at one workplace who have recently been made redundant or have been informed that your role is at risk of redundancy, you may be eligible to bring forward a claim.
- TUPE – If you have recently been (TUPE) transferred to a new employer or informed that you are to be transferred to a new employer, you may be eligible to make a claim.

7 Simple Steps to Make a Protective Award Claim
Below we explain how to make a protective award claim with Morrish Solicitors in 7 simple steps:
- Contact us – Firstly, you will need to contact us with as much information as you can regarding your redundancy or transfer between employers.
- Consultation – Next, we will hold a free initial consultation and assessment where we will evaluate your potential claim.
- Claim submission – After the consultation, if you have a viable claim and instruct us to act for you under a ‘no win, no fee’ agreement, we will submit your claim via ACAS and, if required, an employment tribunal.
- Negotiation – Our experienced employment solicitors will try negotiate a settlement and explore the possibility of a resolution without a full hearing, although this is not always possible.
- Tribunal hearing – In the event that the case cannot be settled beforehand, a Tribunal hearing will take place for a decision to be made.
- Protective award – If the granted in your favour, you could be entitled up to 90 days’ pay (redundancy) or up to 13 weeks’ pay (TUPE)
- Compensation recovery – Where the employer is insolvent, this is recovered from the government’s insolvency service (subject to caps) or in any other case from the employer direct.
