ATL cyclist compensated for injury

A member of the Association of Teachers and Lecturers pursued a claim for personal injuries and consequential loss arising from an accident that occurred when he was knocked off his bicycle.

The members’ accident happened when he was cycling along and a car that was turning right cut across his pathh.

The member somersaulted over the top of his bicycle and landed on his back in the road. He felt immediate pain and was in shock. He attended hospital for treatment.

The member suffered an injury to his chest wall causing severe symptoms lasting 6 weeks and residual symptoms lasting 4 to 5 months. He also suffered minor grazing to his right little finger which healed within a few weeks and a sprain injury to his back, causing aggravation of symptoms for a period of 15 to 18 months.

The third party driver denied liability for the accident, claiming that his vehicle was stationery at the time of the incident and that the member had been cycling erratically. The insurers representing the third party driver offered to settle liability 50/50. This was rejected and Court proceedings commenced.

Following the commencement of Court proceedings, the members’ claim succeeded by way of agreed settlement. The member recovered the full amount of compensation of £5,700.

The member is now in receipt of his damages cheque and legal costs were recovered from the defendant’s insurers.  As a member of ATL, he was fully indemnified against any adverse costs. There was no risk of him having to pay anything in respect of his claim.
