Burn injury claims
According to a report by the National Institute of Health and Care Excellence (NICE), around 250,000 people receive burn injuries each year in the UK alone. Whilst 90% of these are characterised as ‘non-complex burns‘, that still means roughly 25,000 of these injuries are serious. These are surprising statistics given that many serious burn injuries still go unclaimed. Solicitor apprentice in the personal injury team, Chloe Tinsley, discusses these injuries and how you can claim if you have experienced a serious burn.
Burns are the fourth most common type of trauma worldwide, after road traffic accidents, falls, and interpersonal violence. Some of the most common burn injury claims are caused by workplace accidents, road accidents or accidents that occur during surgery and operations.
Serious burns can be claimed for, if they have led to pain, permanent scarring, damaged nerves and/or psychological distress.
Claiming for a burn injury
- You could be entitled to compensation which can cover medical expenses, pain and suffering, lost earnings, disfigurement, scarring, and permanent disability.
- Severity of every burn will differ on a case-by-case basis; therefore, even if you do not have scarring, you might still be able to succeed in making a claim if you can prove negligence and causation.
- Please note that generally, the limitation period lasts for 3 years from the time of the original personal injury incident. Therefore, if this time has passed, you won’t be able to claim.
