Canal Engineering Ltd enters administration
It has been reported that Nottingham-based metalwork firm Canal Engineering has entered administration. The company, established 99 years ago, has ceased trading with all jobs lost at the firm.
This will be a devastating and worrying time for all concerned.
When making redundancies during insolvency, the insolvency practitioners will usually provide staff with information about their rights to claim redundancy, notice, holiday and arrears of pay from the government’s insolvency service because insufficient funds are available for the company to pay those debts. However, unfortunately there are limits to what can be recovered.
Against that background, we specialise in the pursuit of what is called a protective award claim, where staff made redundant could secure additional compensation of up to £5,144.
If an employer is considering making 20 or more redundancies at one workplace, it has a duty to inform and consult with employee representatives before jobs are lost. If an employer fails to do this or fails to do it correctly, claims can potentially be made for compensation. Tribunals can award up to 90 days’ pay per redundant employee (called a ‘protective award’) and in cases of insolvency, up to 8 weeks of this award can be recovered from the government’s insolvency service.
Protective award claims have time limits, so staff affected must act quickly. Claims must be pursued within 3 months (less a day) of the date staff are made redundant, subject to any extension granted by using the ACAS Early Conciliation process.
Please note, there is no minimum length of service requirement to make a protective award claim.
