Case study: 90-day Protective Award Judgment for former Shipham Valves employees

Protective Award Judgment obtained for 90 days’ pay for all of our clients.

In December 2023 it was reported that the historic manufacturer, Shipham Valves Limited appointed administrators. 39 employees were made redundant just two weeks before Christmas. Morrish Solicitors represented 20 of those employees in protective award claims that were lodged in the Employment Tribunal.

It was reported that the business was struggling with cash flow problems as a result of issues with the global supply chain.

No attempts were made to appoint appropriate representatives or consult with employees prior to the redundancies being made.

As a result of the litigation that was pursued, on 27 January 2025 the Employment Tribunal ruled in favour of the 20 former employees represented by Morrish Solicitors. The Tribunal awarded each of them a 90-day protective award Judgment. This the maximum award permitted under this type of claim.

The group was represented by Erin Garnham, a protective award specialist in the employment team. Erin commented:

“There is no right time to be made redundant, however, being told just two weeks before Christmas that you no longer have a job is especially worrying. I am thrilled that our clients have been awarded the full 90-day protective award to compensate them for the company’s failure to consult.”
