Client receives £215,000 compensation following fall in the workplace
The claimant took ill health retirement due to injuries caused by the accident.
We represented the claimant, a Union member, in their personal injury claim after they were hurt in a workplace accident.
The claimant had a pre-existing disability and relied on crutches to stand and walk. Before the accident, their workplace was relocated to new premises. Leading up to the move, they repeatedly told their employer about their access needs—specifically, their difficulty with stairs. Despite this, their new workplace only had access by stairs or a freight lift.
On the day of the accident, the lift was out of order, leaving the claimant no choice but to take the stairs, when they tripped and fell, causing an injury.
They suffered physical injuries, as well as psychological trauma and a worsening of a pre-existing condition. Eventually, they took ill health retirement, arguing that their injuries from the accident forced them to stop working. However, the medical evidence was inconclusive, as it was difficult to separate the impact of the accident from their pre-existing condition.
The defendant denied responsibility, but because they took too long to respond to the claim, the court allowed us to enter judgment against them. The case was settled before trial, with the claimant receiving £215,000. This covered several years’ worth of lost earnings and pension, along with compensation for their injuries and out-of-pocket expenses.
