What is Estate Administration?

Estate Administration is the process of understanding and dealing with the assets and liabilities of an estate following a person’s death. If they left a will, it also involves putting into effect the terms of their Will. 

If someone dies without leaving a Will, this process is known as administration, and their estate will be distributed in accordance with the “rules of intestacy”.  

Before an estate can be distributed, the Executors named in the Will may have to apply for a Grant of Probate, or if the deceased died without a Will, the next of kin may need to apply for Letters of Administration to take control of the estate.

Acting as an Executor of a Will

If you have been appointed as an executor in your loved one’s will, you will likely be responsible for all aspects of administering a person’s estate. To be able to do this, you may need to apply for a Grant of Probate.  

As an executor of a will, your responsibilities will include:

  • Applying for a Grant of Probate 
  • Ensuring that all of the debts, bills and Inheritance Taxes are paid out of the money in the estate. 
  • Distributing the estate according to the wishes specified in the Will.
