Road traffic accident claim settles for £550,000
A Union member has settled their claim after being knocked down by a speeding motorcyclist.
The claimant was crossing the road using a pedestrian crossing when he was hit by a speeding motorcyclist. He suffered severe injuries including open fractures in the leg, head injury, fractured ribs. The injuries were so severe that he was taken to hospital by air ambulance. He also suffered from ongoing psychological trauma.
The insurer of the motorcyclist made no formal admission of liability and attempted to argue contributory negligence, a defence which attempts to place some of the blame on the client. However, this was a weak argument as the motorcyclist was speeding and facing criminal prosecution.
The claim settled for £550,000 despite the lack of admission.
Importantly, our team had fought for rehabilitation costs, as due to the severity of the injuries and the client’s age, recovery could take a long time. The defendant’s insurer agreed to paying these costs, which included modifications to ease accessibility to his home in addition to the £550,000 damages payment.
