What is Gender Reassignment?

Gender reassignment arises where an employee is proposing to undergo, is undergoing, or has undergone, a process (or part of a process) for the purpose of reassigning his or her gender. Gender reassignment is protected by the Act when the person has changed, or plans to change, their physiological or other attributes in order to reassign their gender. In these cases, both transgender men and transgender women share this protected characteristic. 

However, an employee who simply chooses to cross-dress (without any question of change of gender) will not be protected from gender reassignment discrimination. Other forms of protection from discrimination might however apply.

What is Gender Reassignment Discrimination?

Discrimination occurs when someone is treated unfairly or disadvantaged either because of, or for a reason related to, gender reassignment. The unfair treatment could be a single one-off act, a series of acts or arise as a result of a discriminatory rule or policy that has a disproportionate impact on those with the protected characteristic. It does not have to be intentional to be unlawful. 

Bringing a discrimination claim

If you feel you have been discriminated against because of your gender reassignment, you may be able to bring a claim to an employment tribunal. Claims must be brought within three months (less one day) of the act complained of subject to any extension of time granted by correct use of ACAS Early Conciliation. 

Where discrimination has occurred over a period of time, the claim can be brought within three months (less one day) of the last act in a series of interconnected, linked acts, subject to any extension of time granted by correct use of ACAS Early Conciliation. 

If you wish to bring a claim against your employer, it is important to note that in most cases you must submit a written grievance to your employer complaining of the discrimination. A failure to do so could result in any compensation being reduced by up to 25%.
