Can my employer make changes to my contract?

Changes to your contractual terms and conditions are only lawful when they are permitted by the contract or achieved with your consent. If your employer wishes to change the terms of your contract, they must generally consult with you and/or an employee representative before doing so. They must also explain the reasoning behind the proposed changes and listen to any alternative solutions you put forward. 

If your employer makes changes without the power to do so or your consent, you may have the right to refuse to work under the new terms. Alternatively, if you find the new terms impossible to accept, you may be entitled to treat the change as a breach of contract and resign. You may then have grounds to take action for constructive dismissal. 

Your employer might also try to force through changes to your contract by “fire and rehire” tactics. In this case, you might be dismissed from your old contract with notice and have the option to accept the new contract with amended terms or not. Such a situation can result in an unfair dismissal claim.     

It is important to note that refusing to work, or resigning in protest, are both very serious steps. We would always advise that you seek professional advice from a solicitor before taking action.

Does a change of business ownership effect my contract?

If your employer has sold or transferred all, or part, of their business to another owner, your new employer may wish to impose new terms on you and your colleagues.  

In such a case, your contractual rights are protected by law under the Transfer of Undertakings (Protection of Employment) Regulations, also known as TUPE
