Collective Redundancy

When more than 20 people are being made redundant at one workplace (Collective Redundancy) there is a legal requirement for consultation with employee representatives, as well as individual consultation. A failure to comply with consultation requirements can give rise to a claim for a Protective Award.

Redundancy Payments

If you are made redundant, you may be entitled to a redundancy payment and possibly further compensation if the decision to dismiss was unfair.  

You won’t be entitled to statutory redundancy pay if you have less than 2 years’ service with your employer. However, if you have over 2 years’ continuous service, you can expect to receive: 

  • <22 years old: Half a week’s pay for every year served.  
  • 22-40 years old: 1 week’s pay for every year served. 
  • 41 years or over: 1.5 week’s pay for every year served. 

It is important to note that you are not entitled to more than 20 years’ worth of redundancy pay.  

Where enhanced redundancy payments are made, employers will often insist on employees signing a Settlement Agreement prior to agreeing to make redundancy payments.

Redundancy Notice Period

If you are being made redundant, you must be given notice (or a payment in lieu of notice must be made). The length of the notice period or amount of payment in lieu varies depending on your contract of employment and how many years’ service you have with the employer: 

  • <2 years employment: 1-weeks’ notice 
  • 2-12 years employment: 1-weeks’ notice for each year served 
  • >12 years employment: 12 weeks’ notice 

The above are the statutory minimum periods.  

You should always check your contract of employment in these situations, as you may contractually be entitled to a longer notice period than indicated above.
