I’m suffering from domestic violence. What are my options?

If you are suffering at the hands of domestic abuse or violence, the law is on your side. The law safeguards victims of domestic violence through protective measures, known as injunctions.  

An injunction is designed to protect you and any children you may have from being threatened or hurt by your abuser.  

There are two main types of injunctions: 

Non-molestation Order

A non-molestation order is granted by a Court under the Family Law Act 1996. This type of order prevents your abuser from being able to behave in a particular way towards you.  

A non-molestation order can be made against a range of people, regardless of whether you are currently in a relationship with them, or you previously had a relationship with them. This could include a spouse, civil partner, boyfriend, girlfriend or family members you live or have lived with.  

Occupation Order

An occupation order prohibits a person from living in your home or entering the residence. Occupation orders can also provide rules on how the home can be used, for example, when a certain person can visit and which areas of the property they are able to use. 

If an individual breaks an injunction, they may be arrested, fined or potentially imprisoned.
