On 31st May 2021, the Ministry of Justice introduced the new Whiplash Reforms in England and Wales, which changed the way personal injury claims are processed for those wishing to pursue a claim for whiplash injuries arising from a road traffic accident. It also impacted the amount of compensation you may be able to claim for whiplash injuries.

What is a Whiplash Injury

Under the new reforms there is a new definition for what is classed as a whiplash injury. A whiplash injury is now defined as soft tissue injuries to the neck, back or shoulder.

The amount of compensation you can claim for your whiplash injuries will be valued against the set tariff, which has set very low levels of compensation for most whiplash injuries meaning the amount of compensation you may receive has drastically reduced.

Making a Whiplash Injury Claim

Can I make a whiplash injury under the new reforms? Yes, if you have suffered whiplash injuries because of a road traffic accident you can make a claim. For road traffic accidents that occurred on or after 31st May 2021, the new Whiplash Reforms will change the way your claim is managed meaning:

  • Your claim must be submitted through the new Official Injury Portal.
  • Your whiplash injuries will be valued against the set tariff.
  • You will be unable to include any legal fees or costs in your claim

However, if you are classed as a ‘vulnerable road user’ you will not be affected by the whiplash reforms and will continue to claim in the same way as before the reforms. An individual classed as a vulnerable road user is someone who at the time of the accident was:

  • Riding a motorcycle
  • Riding a bicycle or other pedal cycle
  • Riding a horse
  • The passenger of a motorcycle, either a pillion passenger or a sidecar passenger
  • Using a wheelchair, powered wheelchair or mobility scooter
  • A pedestrian

Also, children and other protect parties such as people who lack the mental capacity to deal with their own affairs, will not be affected by the reforms and will continue to claim as they did before.
