TSSA member receives £29,000 following road traffic accident

They were awarded the compensation following medical evidence that showed the acceleration of arthritis by 15 years. 

The claimant, a cyclist, was knocked off his bike by a car at a roundabout and sustained an injury to his knee as well as various soft tissue damage and psychological symptoms. He is a member of the TSSA and was referred to our personal injury team.  

The defendant (insurer in contract of the driver) admitted liability in full and it was said that the collision was caused by the driver’s negligence. They were driving too fast, failed to look properly and failed to stop.  

A medical expert found that the injury sustained to the client’s knee seriously accelerated the onset of arthritis. If the accident had not happened, then the claimant would not have experienced the symptoms of arthritis in the knee for at least another 15 years. As the client is young and athletic, he would benefit from expensive medical treatment to help alleviate these symptoms. The cost of this treatment was added to the claimant’s financial loss claim. 

We advised that his whole claim was worth in the region of £28,000 and they accepted the Defendant’s offer of £29,000.
